How long does the broker keep the data?
The broker does not retain data longer than necessary. However, some data the broker keeps for a long time:
- Some records of service are kept by the broker for 20 years because the broker can be held liable for professional misconduct during this period.
- The evidence that the broker has performed the mandatory test under the Money Laundering and Terrorist Financing Act (Wwft) shall be kept by the broker for 5 years.
- You are selling your home and you have engaged the real estate agent to do so
The purpose of this contact is to promote your home on your behalf, understand the value of and interest in your home, arrange viewings, and negotiate and oversee the transaction on your behalf. In doing so, the broker also establishes your identity. The following data may be processed:

Data use by the Branch organization
The broker provides certain data to the Industry Organization (NVM, Vastgoedpro etc.) via a link.
The relevant Branch organization is the processor responsible for the data received. The Branch organization does the following with this data:
- Ensure that all brokers have a current supply of homes and commercial properties that are or will be offered through brokers.
- Ensuring that current listings are posted on Funda and other (housing) websites.
- Provide a database allowing for appraisals and other valuations and building insights on developments in the residential and commercial real estate market.
A Current supply of residential and commercial properties from brokers
If you want to sell/lease a home or commercial property through a broker, the following information will be disclosed to other brokers:
- The address of the home or business premises, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, cadastral data, WOZ value and photos of the property.
- Date the property goes on the market, date the property is taken off the market. Conditional sale, date of sale and transaction price.
This data is used by real estate agents to provide services to their clients (home or commercial property searchers).
This data is kept indefinitely in connection with the database of historical offerings, see under C.
B Current supply of residential and commercial properties on (housing) websites, including Funda
If you want to sell/rent out a home or commercial property through a real estate agent, they can also publish details on Funda and other (housing) websites in consultation with you. This includes the following data:
- The address of the home or business premises, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, cadastral data, WOZ value and photos of the property.
- Date the property goes on the market, sale date.
This data is used to bring your property to the attention of consumers, professional parties and/or third parties who themselves search via (housing) websites.
This information may still be visible on these websites for up to one year after the date of sale or the date a property is taken off the market.
C Database of historical offerings
Of all homes and commercial properties that are offered for sale or rent through a real estate agent, the following information is recorded in the database of the relevant Branch organization:
- The address of the home or business premises, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, cadastral data, WOZ value and photos of the property.
- Date the property goes on the market, date the property is taken off the market. Conditional sale, transaction date and transaction price.
- The zip code (1234AB) and house number of the buyer’s previous (residential) address.
The aforementioned data are kept indefinitely.
With the aforementioned data, the respective Branch organization enables analyses of the real estate market.
The relevant Branch organization further provides this data to selected third parties, namely:
- Appraisers, for doing appraisals and other valuations.
- Validation institutes, after being explicitly instructed to do so by an appraiser, to check appraisal reports.
- Municipalities, for determining WOZ values.
- Ministry of Infrastructure and Water Management, for housing market research.
- Universities, for research purposes.
- Brokers in the course of providing services to their clients.
These parties only have access to data for the stated purposes and where possible, data is provided only at an aggregate level.
